The Center for Heirs’ Property Preservation® (CHPP®), a nonprofit organization established in February 2005, has a mission of protecting heirs’ property (HP)—a form of landownership—and promoting the sustainable use of land to provide increased economic benefit to low-wealth families through education, advocacy, legal services, and forestry technical assistance primarily in the counties of Allendale, Bamberg, Beaufort, Berkeley, Calhoun, Charleston, Chesterfield, Clarendon, Colleton, Darlington, Dillion, Dorchester, Florence, Georgetown, Hampton, Horry, Jasper, Kershaw, Lee, Marlboro, Marion, Orangeburg, Richland, Sumter and Williamsburg in South Carolina.
In addition, CHPP™ has a national and regional leadership role in providing expertise on the issue of HP and in developing business models for best practices in the work needed to address the HP issue in all its complexity.
Position Description
CHPP® is a rapidly growing, results-oriented, small team workplace seeking a smart, energetic, and committed individual to join the Legal Department as the Staff Attorney. Under the supervision of the Director of Leal Services, this position performs such duties as conducting client intakes and providing consultations and direct legal representation on legal matters pertaining to heirs’ property, tenancy in common rights, probate estate administration, interstate inheritance, chain of title issues, tax sales, quiet title action, land partition matters, and the drafting of Wills and Advanced Directives. The position also requires full participation in community outreach efforts and events within the Center’s service area which will include evening and weekend work.
The two (2) Attorney positions are full-time equivalent, exempt positions. The home office for the two positions will be at the Center’s Orangeburg Office located at 396 St. Paul Street, Unit 105, Orangeburg, SC. 29115.
After initial training, the position will be a remote work position covering Orangeburg and Richland Counties.
Essential Job Functions
- Has knowledge of the administration of probate estates and real property matters.
- Has a thorough knowledge of practices, policies, procedures, rules, and regulations governing the practice of law in the State of South Carolina.
- Can use judgment in following Project standards and does not deviate from them.
- Can effectively translate complex legal issues into terms clients can understand.
- Can develop partnerships for the benefit of the Center.
- Possesses capability to deal with individuals from various backgrounds including clients and agency personnel.
- Is knowledgeable of laws and regulations relative to Heir’s Property
- Can analyze legal problems of clients and determine the appropriate strategy for obtaining desired results in coordination with attorneys.
- Able to attend and participate in training courses to expand knowledge in area of duties and responsibilities.
- Is knowledgeable of deadlines and procedural rules governing the Center.
- Can work in stressful situations.
- Can communicate effectively both orally and in writing with individuals under varying degrees of stress.
- Have previously demonstrated administrative skills, communication skills and the ability to interface with all socio-economic levels.
- Have a strong commitment and belief in the concept of alternative dispute resolution.
- A willingness to engage in outreach work in the project service area.
- A self-starter who is internally driven with the ability and maturity to work in a satellite office with little direct supervision.
Desired Experience, Education, Skills, and Knowledge
- Juror Doctorate degree from an accredited law school with acceptance to the SC Bar.
- Completion of the 403 requirements or ability to complete within 3 months.
- Has at least one year of experience in handling the administration of probate estates and Petition to Determine Heirs actions and familiarity with the quiet title process.
- Must be a member in good standing of the South Carolina Bar with no South Carolina Bar Disciplinary issues.
- Experience and/or knowledge in real property title review and transactions and a working knowledge of the processes involved in the offices of public land records, i.e., the RMC, Probate and Clerks of Court.
- Capability to maintain project records and reports using technology and experience in using this information to prepare project-related reports for management, partners and funders.
- Able to work evenings and weekends, as needed/required.
- Proven ability to work as part of a team in shared office space.
- Capability to deal with individuals from diverse backgrounds.
- Experience either in working or volunteering for a nonprofit social service organization.
- Empathetic to the special values and challenges of heirs’ property owners and other historically underserved landowners.
Compensation
Hiring Range: $50,000 - $60,000
Compensation consists of (1) a base salary that is dependent upon the level of experience and falls within Center Pay Grade 9 ($50,000 - $60,000) and (2) benefits (i.e., paid leave, company paid health and dental insurance, and retirement contribution).
